These Terms of Use ("Terms") govern access to and use of the Mylar Pro Brokers mobile application (the "App"), provided by My Lar, CNPJ 54.865.990/0001-50 ("Mylar Pro", "we"). By installing, accessing, or using the App, you ("user", "broker") declare that you have read, understood, and fully accepted these Terms and our Privacy Policy. If you do not agree with any provision, do not use the App.
1. Purpose
The App is a professional tool complementary to the Mylar Pro platform, intended for real estate agents, inspectors, and other professionals authorized by contracting agencies to perform operational activities such as managing leads, clients, properties, inspections, contracts, negotiations, events, and notifications.
Access to the App is granted by the contracting agency (Organization) and may be revoked at any time by the agency or by My Lar, pursuant to these Terms.
2. Eligibility and registration
To use the App, you must:
• Be 18 years of age or older, or legally emancipated;
• Be affiliated, as an agent or authorized professional, with an active real estate agency client of the Mylar Pro platform;
• Provide true, current, and complete information during registration;
• Keep your access credentials confidential and remain responsible for all activities performed with your account.
My Lar may require validation of real estate license (CRECI) or other professional documents pursuant to applicable law and the contracting agency's policies.
3. License of use
My Lar grants you a personal, limited, revocable, non-exclusive, and non-transferable license to install and use the App solely for the purposes stated in these Terms, for as long as your active affiliation with a client agency lasts.
The following are expressly prohibited:
• Copying, modifying, distributing, selling, or renting any part of the App;
• Reverse-engineering, decompiling, or disassembling the code;
• Using the App for unlawful or fraudulent purposes or to violate third-party rights;
• Removing, hiding, or altering any intellectual property notice;
• Using bots, scrapers, or any automated mechanism to extract data.
4. User responsibilities
You are responsible for:
• Ensuring the accuracy and currency of data entered in the App (clients, properties, inspections, contracts);
• Obtaining proper consent from clients and third parties before entering their personal data into the App, acting as an operator on behalf of the contracting agency;
• Using the App ethically and in compliance with the Brazilian Real Estate Agents' Code of Professional Ethics (COFECI Resolution No. 326/92) where applicable;
• Keeping your device secure, with an updated operating system and without modifications such as root or jailbreak;
• Immediately notifying My Lar of any unauthorized use of your account.
5. User-submitted content
By submitting content to the App (inspection photos, documents, texts, electronic signatures), you declare:
• That you hold all necessary rights, licenses, and authorizations over the content;
• That the content does not infringe third-party rights, laws, or copyrights;
• That you agree to the use of the content by the contracting agency, by My Lar, and by the operators described in the Privacy Policy, solely to enable the App's features.
My Lar does not pre-review submitted content but reserves the right to remove material that violates these Terms, applicable law, or third-party rights.
6. Intellectual property
All content, trademarks, logos, source code, interfaces, texts, images, design, and features of the App are the exclusive property of My Lar or its licensors, protected by Brazilian and international intellectual property law (Law No. 9,610/98 and Law No. 9,279/96).
No provision in these Terms transfers to you any intellectual property right over the App or its components.
7. Third-party services
The App may integrate with third-party services (Google Maps, Firebase, Cloudflare, Stripe, ASAAS, Evolution API, SendGrid, Twilio). Such services are governed by their own terms and policies, over which My Lar has no control. We recommend reading the respective terms before using integrated features.
8. Availability and changes
My Lar uses its best efforts to keep the App available but does not guarantee uninterrupted or error-free operation. Scheduled or emergency maintenance, updates, and downtime may occur.
My Lar may, at its sole discretion, add, modify, suspend, or discontinue features of the App, with or without prior notice.
9. Suspension and termination
My Lar may suspend or terminate your access to the App, immediately and without prior notice, in the following cases:
• Violation of these Terms or the Privacy Policy;
• Termination of affiliation with the contracting agency;
• Failure to comply with legal or regulatory obligations;
• Fraudulent, unlawful, or abusive use of the App;
• Judicial or administrative order.
You may terminate your account at any time within the App (Profile → Delete account) or by emailing [email protected].
10. Limitation of liability
To the maximum extent permitted by applicable law, My Lar shall not be liable for:
• Indirect damages, lost profits, or loss of business opportunity;
• Losses arising from user errors in data entry or maintenance;
• Failures of connectivity, device, operating system, or third-party services;
• Content published by other users or by contracting agencies;
• Force majeure or acts of God.
Nothing in these Terms limits My Lar's liability for willful misconduct, fraud, or direct damages caused by gross negligence.
11. Changes to the Terms
My Lar may update these Terms periodically. The current version will always be available at https://mylarpro.com.br/brokers/terms-of-use. Material changes will be communicated within the App and/or by email at least 15 days in advance. Continued use after the effective date of the changes implies acceptance.
12. General provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force. My Lar's tolerance of any breach does not constitute novation or waiver.
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the user's domicile shall have jurisdiction over any disputes, with subsidiary application of the Brazilian Consumer Protection Code where applicable.
